PHYSICAL ACTIVITY, HEALTH WAIVER AND CONSENT: I accept full responsibility for my use and full responsibility for the use by my minor children of any and all apparatus, appliances, facility privileges, or services whatsoever, owned and operated at this club at my own risk, and shall hold this club, its owners, shareholders, directors, officers, employees, employers, representatives, and agents harmless from any and all claims, injury, damage or liability sustained or incurred by me or my minor children resulting therefrom regardless of negligence, as a result of: (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction; (b) the sudden and unforeseen malfunctioning of any equipment; (c) our instruction, training, supervision, or dietary recommendations; or (d) your slipping and/or falling while in the club, or on the club premises, including adjacent sidewalks and parking areas. This also includes any negligence associated with the presence of or transmission of any bacteria, viruses, or infectious disease. I grant permission to be contacted through telephone, text, email, and mailings via live agent, recordings, automated drip email and/or text messaging and other forms of communication including emerging artificial intelligence [ai] technology.

PARTICIPATION CONSENT AGREEMENT: I consent to my image and voice being recorded and/or live-stream broadcasted, posted on social media channels, and used in all forms of media advertising whenever I am on the premises including when I am participating in any physical activity and/or group fitness exercise class.

I hereby agree and intend to be bound by this electronic document to be electronically recorded and filed in Fitness Centers Customer Relations Management software (a copy of which will be made available to me upon future written request).
